These Terms & Conditions (“Terms”) govern your access to and use of the website, booking tools, communications, and services provided under NEWFOUNDWorks, a service brand operated by NFW Holdings Inc. (“NEWFOUNDWorks”, “NFW Holdings Inc.”, “we”, “our”, or “us”).
By accessing our website, requesting a quote, contacting us, booking a service, submitting payment, or otherwise using our services, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use our website or services.
1. Scope of Services
NEWFOUNDWorks provides access to, coordination of, and/or operational support for a range of home, property, rental, and property management-related services, which may include, but are not limited to:

Airbnb / short-term rental cleaning

lawn care
-
dog waste removal
-
snow clearing
-
driveway sealing
-
vehicle detailing
-
dump runs
-
maintenance-related support
-
rental support services
-
short-term rental turnover support

property oversight

tenant / guest communication support

property management services
-
future services added from time to time
Services may vary by location, availability, season, weather, property condition, contractor availability, job conditions, management scope, and operational limitations.
We reserve the right to decline, cancel, reschedule, modify, restrict, or discontinue any requested service or property management engagement at our discretion.
2. Booking Requests and Service Acceptance
Submitting a booking request, inquiry, estimate request, service payment, or management inquiry does not automatically guarantee service.
All bookings, quotes, management requests, and service engagements are subject to:

availability

scheduling capacity
-
staffing or contractor availability
-
weather and site conditions
-
service area eligibility
-
property suitability
-
operational approval
-
management fit and business suitability
NEWFOUNDWorks reserves the right to reject, decline, pause, or cancel any booking or engagement before or after acceptance if we determine that the requested service, property, timeline, access, customer conduct, management expectations, or job conditions are unsuitable, unsafe, unserviceable, or outside our normal operating scope.
3. Quotes, Pricing, and Estimates
All pricing, estimates, advertised rates, examples, service tiers, and package structures are subject to change at any time without notice.
Quoted pricing may be based on customer-provided information, visible property details, standard assumptions, expected service conditions, estimated size, time, or scope.
If the actual property condition, access, size, contamination level, buildup, weather severity, damage level, service difficulty, tenancy condition, rental complexity, or operational scope differs materially from what was expected, NEWFOUNDWorks reserves the right to:

adjust pricing
-
revise the quote
-
pause or stop service
-
require additional payment
-
reclassify the job
-
convert the service to a custom quote
-
limit or refuse the service
Any non-standard, neglected, oversized, unusually difficult, highly customized, or operationally complex job may require revised pricing or separate approval.
4. Payments
Payment may be required before, at the time of, or after service depending on the service type, billing structure, and payment method used.
By booking a service or engaging our management division, you agree to pay all applicable amounts, including:

service fees

taxes
-
add-ons
-
custom charges
-
recurring charges
-
booking-related charges
-
management fees
-
tenant placement fees
-
approved service adjustments
-
cancellation or missed appointment charges where applicable
Failure to make payment may result in:

cancellation or suspension of services
-
refusal of future bookings
-
withholding of service-related records or scheduling
-
collections activity
-
legal enforcement
-
account restriction or termination
NEWFOUNDWorks reserves the right to pursue unpaid balances, disputed charges, chargebacks, or fraudulent payment activity.
5. Cancellations and Refunds
Customers may cancel a booked service for a full refund if cancellation is requested at least 48 hours (2 full days) before the scheduled service date, and the cancellation is made by contacting NEWFOUNDWorks directly during normal business hours.
Cancellations made with less than 48 hours’ notice may not be eligible for refund.
Unless otherwise stated in writing by NEWFOUNDWorks, all completed services are final sale and non-refundable.
If a customer is dissatisfied with a completed service, the customer must contact NEWFOUNDWorks directly so we may review the issue. Where appropriate and at our discretion, we may offer a return visit, correction, service adjustment, or another reasonable service resolution in place of a refund.
Refunds, corrections, re-service, credits, or service resolutions are granted solely at the discretion of NEWFOUNDWorks.
For property management, onboarding fees, placement fees, coordination work, administrative time, and completed management work may be non-refundable once services have commenced or value has been delivered.
6. Customer and Client Responsibilities
Customers, owners, landlords, hosts, tenants, and service clients are responsible for ensuring that the service location, rental unit, or managed property is reasonably accessible, safe, lawful, and ready for service or management operations.
This includes, where applicable:

providing accurate service or property details
-
ensuring lawful and safe access
-
disclosing hazards, restrictions, or special conditions
-
securing pets where appropriate
-
ensuring utilities or required access points are available if necessary
-
removing or identifying valuable, fragile, hazardous, illegal, or unsafe items
-
providing accurate instructions for gates, entryways, locks, parking, codes, tenant occupancy, or building access
-
ensuring compliance with building, tenancy, condo, landlord, and property rules where applicable
Failure to provide proper access, accurate information, or a reasonably serviceable environment may result in delays, incomplete service, rescheduling, cancellation, additional charges, or refusal of service.
7. Property Condition and Service Limitations
NEWFOUNDWorks provides services based on reasonable operational assumptions and the visible or disclosed condition of the property at the time of booking, inspection, or service.
We do not guarantee that every job can be completed to a customer’s preferred or ideal outcome where factors such as buildup, staining, deterioration, damage, weather, tenancy issues, neglect, contamination, structural limitations, hidden defects, access issues, safety concerns, prior condition, time limitations, or undisclosed conditions affect the service result.
Certain services may have limitations depending on:

-

occupancy status

equipment limitations

access restrictions

management complexity
-
customer instructions
-
surface, material, or structural conditions
NEWFOUNDWorks reserves the right to determine, at its discretion, whether a job falls within normal service conditions or requires upgraded pricing, a custom quote, partial completion, management restrictions, or refusal of service.
8. Access Issues, No-Show, and Incomplete Service
If our team, approved service providers, or field personnel arrive and cannot reasonably complete the booked service due to:

inability to access the property
-
customer no-show
-
locked entry
-
unsafe conditions
-
obstructed work areas
-
aggressive animals
-
undisclosed hazards
-
materially inaccurate booking details
-
tenant refusal or non-cooperation
-
utility issues
-
service-preventing conditions
NEWFOUNDWorks may, at its discretion:

cancel the service
-
reschedule the service
-
partially complete the service
-
apply additional charges
-
treat the booking as fulfilled or partially fulfilled depending on the circumstances
We are not responsible for losses, missed plans, downtime, inconvenience, occupancy interruptions, guest issues, tenant disputes, or downstream consequences caused by access or readiness issues outside our control.
9. Weather, Seasonal, and External Delays
Certain services are weather-dependent or seasonally affected, including but not limited to lawn care, snow clearing, driveway sealing, exterior work, and time-sensitive property support.
NEWFOUNDWorks reserves the right to delay, reschedule, modify, prioritize, or cancel service due to:

weather conditions
-
storm severity
-
snowfall levels
-
rain
-
ice
-
unsafe temperatures
-
unsafe site conditions
-
route delays
-
emergency demand surges
-
traffic disruptions
-
force majeure
-
operational disruptions beyond our control
Timing estimates are not guaranteed, especially during severe weather, seasonal spikes, or emergency service periods.
We are not liable for delays or service impacts caused by weather, traffic, emergencies, equipment failure, labor shortages, municipal disruptions, third-party delays, or other external operational factors.
10. Independent Service Providers and Liability
Services arranged through NEWFOUNDWorks may be fulfilled by independent service providers operating within the NEWFOUNDWorks service network.
These service providers are independent contractors and are not employees of NEWFOUNDWorks or NFW Holdings Inc.
Each independent service provider is:

responsible for performing the service
-
responsible for their work quality
-
responsible for their conduct on-site
-
responsible for maintaining their own valid liability insurance coverage
-
responsible for damages caused directly by their work, actions, omissions, or negligence
NEWFOUNDWorks requires service providers to maintain appropriate insurance and may periodically verify such coverage; however, NEWFOUNDWorks does not guarantee continuous coverage, policy validity, insurer performance, or uninterrupted insurance status at all times.
Customers acknowledge and agree that:

service providers are primarily liable for damages arising from their work
-
any claims relating to service performance or damage may involve the service provider directly
-
NEWFOUNDWorks acts as a coordinating and operating service platform, facilitating booking, scheduling, service delivery, and operational oversight
To the maximum extent permitted by the laws of Newfoundland and Labrador and applicable Canadian law, NEWFOUNDWorks and NFW Holdings Inc. shall not be held liable for damages caused by independent service providers, except where liability cannot legally be excluded.
11. Property Management Services
Where NEWFOUNDWorks provides property management, rental support, or short-term rental management services, such services are provided based on the agreed scope, property condition, owner cooperation, market conditions, occupancy realities, contractor availability, tenant / guest conduct, and operational limitations.
Property management services may include, but are not limited to:

guest and tenant communication

booking management
-
turnover coordination
-
contractor coordination
-
maintenance requests
-
check-ins and check-outs
-
listing optimization
-
pricing strategy
-
inspections
-
damage reporting
-
restocking
-
owner updates
-
rent collection
-
lease handling

tenant screening and information collection
NEWFOUNDWorks does not guarantee:

occupancy rates
-
revenue levels
-
booking volume
-
tenant quality
-
guest behavior
-
rental performance
-
damage-free occupancy
-
uninterrupted tenancy
-
market results
Owners remain responsible for the legal condition, ownership authority, regulatory compliance, property legality, insurance adequacy, tax obligations, licensing, tenancy compliance, and habitability of their property unless expressly agreed otherwise in writing.
A separate management agreement may apply where required.
12. Satisfaction and Service Resolution
Customer satisfaction is important to us, but service outcomes are subject to reasonable operational standards and the actual condition of the property or worksite.
If a customer believes a completed service was materially deficient, the customer must notify NEWFOUNDWorks within a reasonable time after service and provide sufficient detail for review.
NEWFOUNDWorks reserves the right to determine, at its sole discretion:

whether a complaint is valid
-
whether a return visit is appropriate
-
whether the issue falls within the original scope of work
-
whether any resolution is warranted
Service resolution may include a return visit, partial correction, service note, or another internal resolution as determined by NEWFOUNDWorks.
We do not guarantee refunds, do-overs, credits, or subjective satisfaction where results are limited by property condition, service scope, time, access, customer instructions, weather, or expectations beyond the booked service.
13. Damage, Claims, and Reporting
Customers must report any alleged property damage, service-related issue, or claim to NEWFOUNDWorks as soon as reasonably possible after the service or incident.
NEWFOUNDWorks reserves the right to inspect, review, document, investigate, and assess any claim before determining whether any action is warranted.
We are not responsible for:

pre-existing damage
-
hidden defects
-
ordinary wear and tear
-
deterioration
-
issues caused by prior neglect
-
damage caused by unsafe or undisclosed conditions
-
service limitations resulting from the property’s condition
-
tenant or guest-caused issues
-
indirect, incidental, or consequential losses
Failure to report concerns promptly may affect our ability to review or respond to a claim.
Nothing in this section limits any rights or obligations that cannot be waived under applicable Canadian law.
14. Contractor Insurance and Risk Acknowledgment
Customers acknowledge that NEWFOUNDWorks operates using a network of independent service providers who are required to carry their own liability insurance.
While NEWFOUNDWorks performs reasonable vetting and periodic checks, customers understand and agree that:

insurance policies are maintained by third parties

coverage may vary between providers
-
policy status may change between verification periods
-
NEWFOUNDWorks does not act as the insurer or guarantor of any contractor’s coverage
In the event of damages, incidents, or claims, responsibility may fall to the independent service provider and/or their insurer.
To the maximum extent permitted by the laws of Newfoundland and Labrador and applicable Canadian law, NEWFOUNDWorks and NFW Holdings Inc. are not liable for gaps in contractor insurance coverage, policy lapses, insurer denials, or contractor non-performance, except where such liability cannot legally be excluded.
15. Use of Website and Online Content
All content on the NEWFOUNDWorks website, including but not limited to text, service descriptions, graphics, logos, pricing examples, layouts, images, marketing materials, booking flows, designs, and branding, is owned by or used under authority by NEWFOUNDWorks / NFW Holdings Inc.
You may not reproduce, copy, scrape, republish, modify, distribute, or commercially use website content without prior written permission.
We reserve the right to modify, suspend, remove, or update any website content, service offering, price, feature, policy, or functionality at any time without notice.
16. Communications and Consent
By contacting NEWFOUNDWorks, requesting a quote, submitting information, engaging our management division, or booking a service, you consent to receive communications from us regarding:

bookings

confirmations
-
reminders
-
scheduling changes
-
customer support
-
service issues
-
billing
-
operational updates
-
follow-up requests
-
management communications

service-related matters
These communications may occur by phone, text message, email, website forms, social platforms, or other contact methods you provide.
Standard carrier or data charges may apply depending on your provider.
17. Limitation of Liability
To the maximum extent permitted by the laws of Newfoundland and Labrador and applicable Canadian law, NEWFOUNDWorks and NFW Holdings Inc. shall not be liable for any indirect, incidental, consequential, special, punitive, economic, reputational, or business interruption damages arising out of or related to:

services performed by independent service providers

delays, rescheduling, or service interruptions
-
property conditions or pre-existing issues
-
tenant or guest conduct
-
weather or environmental conditions
-
access limitations or customer-provided information
-
third-party systems, tools, or payment platforms
-
dissatisfaction with service results where reasonable efforts were made
-
booking errors or service assumptions based on customer-provided details
-
property management performance, occupancy levels, or rental income outcomes
Where liability cannot be excluded under applicable law, the total liability of NEWFOUNDWorks and NFW Holdings Inc. shall be limited to the amount paid for the specific service or management fee giving rise to the claim.
Nothing in these Terms excludes liability that cannot be excluded or limited under applicable Canadian law, including liability arising from gross negligence, fraud, or willful misconduct where such exclusions are not legally enforceable.
18. Indemnity
You agree to indemnify, defend, and hold harmless NEWFOUNDWorks, NFW Holdings Inc., and their affiliates, officers, directors, personnel, service providers, contractors, operators, and representatives from and against any claims, losses, damages, liabilities, costs, expenses, or demands arising out of or related to:

inaccurate or incomplete information provided by you

unsafe, illegal, or undisclosed property conditions
-
your misuse of our website or services
-
your breach of these Terms
-
disputes involving access, tenancy, instructions, property conditions, guest issues, or service expectations

regulatory or legal issues tied to a property you own, control, rent, host, or submit for management or service

third-party claims arising from your booking, property, tenants, guests, or use of our services
This section shall survive the completion, cancellation, or termination of services.
19. Right to Refuse or Terminate Service
NEWFOUNDWorks reserves the right to refuse, limit, cancel, suspend, terminate, or permanently deny service, management, or future business to any customer, property, owner, tenant, booking, or request at our discretion, including where we believe there are issues involving:

safety

abuse, threats, or harassment

fraudulent activity
-
non-payment
-
unreasonable demands
-
repeated disputes
-
unsuitable property conditions
-
operational incompatibility
-
access problems
-
policy violations
-
reputational, legal, or business risk
20. Changes to These Terms
NEWFOUNDWorks may revise, update, modify, or replace these Terms at any time without prior notice.
Updated versions become effective upon posting to our website unless otherwise stated. Continued use of our website, services, or management offerings after changes are posted constitutes acceptance of the revised Terms.
21. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Province of Newfoundland and Labrador and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes arising from these Terms or the use of our services shall be subject to the applicable courts or legal processes having jurisdiction in Newfoundland and Labrador, unless otherwise required by law.
